After submitting to the New York State Department of State, the applicant is legally obliged to provide a certified copy of the Certificate of Incorporation along with a $20. $00 registration fees (check or payment order to the New York State Education Department).

An authenticated copy can be applied for and ordered from the Ministry of Foreign Affairs at the moment of submission. Once the notarized copy has been received, the Ministry of Education will place it on the Office of the Professions website and the procedure will be completed. In general, the Education Act limits the exercise of the occupation to those who are authorised or otherwise authorised to render professionally provided ser-vices (e.g. licence holder and supervised students) and to those who are authorised to hire licenced specialists or skilled people.

Before adopting admission legislation restricting the exercise of occupations in the fields of welfare work, psychiatry and psychology to those admitted to these occupations, any natural or legal person could render certain specific psychotherapeutic work. Licensing legislation, however, restricts many of these activities to licenced private users and requires that the provision of these professionally performed activities be performed only by authorised personnel or bodies entitled to hire licenced specialists or otherwise skilled personnel.

Whereas most non-profit and educational companies are not entitled to offer business service, Sections 130 and 132 of the 2010 Laws have established a new Section 6503-a of the Educational Act to introduce a procedure whereby the department can waive the right to empower qualifying non-profit or educational companies to do so.

Exempt institutions are entitled to perform certain types of professionally performed service, which includes psychological therapy, and to hire individuals authorised or authorised to perform these professionally performed work. Completely completed bylaws submitted under section 1203 of the New York State Business Corporation Law together with the necessary registration fees of $10.00 per member/manager (check or order to the New York State Education Department).

We will enclose a certificate authorizing the LLC to practise the specified occupation and confirm that all members/managers of the nominated private corporation are entitled to practise the occupation and resubmit it to the applicant.

Applicants must then present both papers to the New York State Department of State for registration (www.dos.ny.gov). After submission to the New York State Department of State, the applicant is legally obliged to provide the Ministry of Education with a notarised copy of the statutes. An authenticated copy must be obtained from the Ministry of Foreign Affairs when submitting the application.

Once the notarized copy has been received, the Ministry of Education will place it on the Office of the Professions website and the procedure will be completed.
